3. Services and Engagement

Details of our advisory services — including scope, fees, and timelines — are agreed in writing prior to commencement. These terms apply alongside any specific engagement letter or service agreement issued by Kestrel Bay.

• Workflow Tidy-Up Session (RM 510): Scoped to a single working session with a written suggestions note delivered thereafter. Session scheduling is subject to adviser availability.
• Productivity Habits Engagement (RM 2,300): Delivered over four to six weeks. Scope includes workshops, a habits guide, and one follow-up check-in as agreed in writing.
• Operating Rhythm Programme (RM 4,200): Delivered over six to ten weeks. Scope includes workshops, a rhythm playbook, and one leadership briefing session as agreed in writing.

Fees quoted are in Malaysian Ringgit (RM) and are exclusive of any applicable taxes unless stated otherwise. Payment terms are outlined in the individual service agreement.

4. Intellectual Property

All content on this website — including text, graphics, layout, and structure — is the property of Kestrel Bay Sdn Bhd or its licensors and is protected by applicable intellectual property law. You may not copy, reproduce, or distribute any part of this site without prior written consent.

Deliverables produced under a service engagement (such as playbooks, guides, and session notes) are governed by the terms of the relevant engagement agreement. Where not otherwise specified in writing, materials produced for a client remain the intellectual property of Kestrel Bay until full payment is received, at which point a licence to use them for the client's internal purposes is granted.

5. Confidentiality

During an engagement, both parties may share information that is sensitive or proprietary. Kestrel Bay treats all client information shared in the course of an engagement as confidential and will not disclose it to third parties except where required by law or with the client's consent. Clients are asked to treat any Kestrel Bay methodologies, frameworks, or working materials shared during an engagement with similar discretion.

6. Cancellation and Rescheduling

For scheduled sessions and workshops, we ask for reasonable notice of cancellation or rescheduling. Specific terms are set out in the engagement agreement. In general:

• Requests to reschedule received more than five working days in advance can be accommodated without charge, subject to availability
• Cancellation of an engagement after commencement may be subject to a charge reflecting work already completed
• Kestrel Bay reserves the right to reschedule sessions due to unforeseen circumstances and will provide reasonable notice where possible

7. Limitation of Liability

Kestrel Bay provides advisory and facilitation services. Our engagements are designed to support your team's working practices, but outcomes depend on many factors beyond our direct control, including the actions of your team, organisational culture, and business environment.

To the extent permitted by law, Kestrel Bay's total liability in connection with any engagement shall not exceed the fees paid by the client for the specific service in question. We shall not be liable for indirect, consequential, or incidental losses. Nothing in these terms excludes liability for fraud or for any matter which cannot be excluded under Malaysian law.

8. Third-Party Links

This website may include links to external websites for your reference. These links are provided as a convenience and do not imply endorsement of those sites or their content. We have no control over third-party sites and accept no responsibility for their content, availability, or practices.

9. Privacy
